The Nelspruit Magistrateās Court granted four further judgments today against the Nelspruit City Improvement District (CID) for repayment of illegally collected levies. The four judgments together total a capital amount in excess of R250 000,00 excluding interest and costs. These judgments follow the opposed matter in which the CID was ordered to repay levies based on a decision of the Supreme Court of Appeal rendering CIDās illegal and unconstitutional. According to the CID attorneys, the CID intends taking the matter on appeal, however the timeframe for noting an appeal has expired with nothing forthcoming. It is also not clear on what basis the CID intends appealing a decision of the SCA which the Nelspruit Magistrateās Court merely followed as it was obliged to legally do.
Further actions are being considered against the other CID in Nelspruit operating in Riverside for an amount in excess of R500 000,00. The CID has failed to make payment in terms of the judgments and consequently action will now proceed against the Municipality of Mbombela as well as a possible application for liquidation of the CIDās.
